If circumstances change after a domestic violence order is made, either party can apply to a Magistrates Court to vary the conditions of the order. The Queensland Court’s website has information available on applying to vary the conditions of domestic violence orders and also offers the option to lodge your application online.
All parties to an order, including the respondent, aggrieved, and any named persons can apply to vary the conditions or operational period of the order.
For example, you may wish to apply to extend the operational period if your order is due to expire soon.
Another common situation is when the police have applied for an order on your behalf but you are not happy with the conditions put in place, after a time you can apply to a Magistrates Court to vary those conditions.
If you would like to apply to the Court to vary a domestic violence that is currently in place our experienced solicitors can assist. Call Aitken Whyte Lawyers Brisbane on 07 3229 4459 or follow the links below for more information on Domestic Violence.
