The Queensland Government has recently reinstated the Drug and Alcohol Court in the Brisbane Magistrates’ Court. This court is aimed at assisting offenders who suffer from drug and alcohol issues and are at a high risk of reoffending and are facing sentences of imprisonment. The Court offers an alternative sentencing option of a Treatment Order, encompassing suspended sentences and rehabilitation programs, to actual imprisonment if the offender is eligible and a willing participant.
In order to be considered eligible, an offender must be willing to enter a plea of guilty and must be charged with eligible offences. These include some possession, possession of property, production and supply related offences, depending on the circumstances. If an offender is charged with sexual assault offences, is serving a term of imprisonment or is subject to a parole order then they will not be eligible.
Currently, this program is only offered in the Brisbane Magistrates’ Court catchment area.
